This program (sponsored by SCRLC) will provide an overview of the overtime exempt employee regime and factors, as recently changed by the publishing of updated federal regulations under the Fair Labor Standards Act (FLSA). This increase means that some organizations that were controlled by NY's (more employee deferential) rules, may now be required to conform to the now-higher federal rules.

Libraries, including private, nonprofit, and hospital and/or school affiliated…will each have a different analysis in determining whether all, none, or just some of their employees are controlled by the updated FLSA overtime exempt rules.

This presentation will shed light on these criteria, and hopefully empower each such institution to initiate an internal review of their self-specific situation.

Materials presented will be available after the webinar to participants, and further questions will be collected via text during the webinar. Those questions not clarified during the presentation will be briefly answered by a follow-up from NYCON after the event.



Michael West has conducted extensive training for non-profit boards of directors and executive staff, and provides a wide variety of legal services to tax-exempt organizations. He is a graduate of Rutgers University and the Albany Law School of Union University, where he served as an executive editor for the Albany Law Review. He has represented clients in all areas of criminal and civil litigation, but his practice is now devoted exclusively to issues concerning the non-profit community.
